Right I have just seen this:
(1) The staff of the National VET Regulator are to be persons engaged under the Public Service Act 1999.
(2) For the purposes of the Public Service Act 1999:
(a) the Chief Executive Officer and the staff of the National VET Regulator together constitute a Statutory Agency; and
(b) the Chief Executive Officer is the Head of that Statutory Agency.
Ok so a little more terminology ...
Chief Executive Officer
Under (s 179) (and beyond) it talks about a Chief Executive Officer. It goes on to say that the NVR will have one and the Chief Commissioner is the Chief Executive Officer
I really should have picked that up at the beginning when under definitions (Section 3) it said
Chief Commissioner means the Chief Commissioner appointed in accordance with subsection 162(4).
Chief Executive Officer means the Chief Commissioner: see section 179.
So the 3 Commissioners together are “the NVR” but they are NOT a Statutory Body
BUT the Chief Commissioner who is also the Chief Executive Officer (with their staff ... well staff of the NVR) constitute a Statutory Agency and Chief Executive Officer is the Head of that Statutory Agency.
(Still doesn’t really explain AQSA ... but does it?)
